User Agreement

This User Agreement (“Agreement”) is a contract between you and Mountains of Groceries and applies to your use of the services provided by Mountains of Groceries.  By placing an order with us, you are indicating that you have read, agreed with and accepted all of the terms and conditions contained in this Agreement.  We may amend this Agreement at any time by posting a revised version on our website.  Your continued use of our services constitutes your acceptance of any changes to this User Agreement.  We last revised this Agreement on June 1, 2009. 

 

Mountains of Groceries is an independent contractor for all purposes, except that Mountains of Groceries acts as your agent only with respect to custody of your funds.  Mountains of Groceries does not have control or liability for the products that are purchased from other vendors or retailers.  You agree that Mountains of Groceries will not be held liable for the ingestion or use of any items delivered that cause any allergies, sickness or death, as we are not the manufacturer of said items.  It is not our responsibility to be aware of which products or items may cause you, your family, or friends, harm, and we are not responsible or liable for the misuse of any products or items.  

 

It is the policy of Mountain of Groceries to purchase only the items ordered, but you agree that Mountains of Groceries is not obligated to do so if the items do not meet our satisfaction standards.  We reserve the right to not deliver an item ordered if it is unavailable or unsatisfactory. If we have accidentally purchased an unordered item, we guarantee either your money back, or the purchase of a pre-approved replacement item.

 

Protecting your privacy is very important to Mountains of Groceries.  All personal information will be kept confidential.  You agree to provide us with your credit card information prior to placing an order and you expressly authorize us to charge your credit card once the order is delivered.  We do not accept cash.  All credit card payments are processed under the security of Authorize.net. After your groceries are delivered, the total cost of the groceries (with the exception of alcohol) plus 20%, as well as the flat fee of $40 for our services will be charged to your credit card.  All fees are non-negotiable and must be paid immediately.  Upon verbal or written consent of the customer, Mountains of Groceries reserves the right to charge an additional fee for all services performed above and beyond what we have presented here.

 

Mountains of Groceries MUST use the client’s credit card to purchase alcohol.    Mountains of Groceries may require you to fax a valid Identification Card or Driver's License for proof of 21 years of age for all alcohol orders, which must match the name on the order. To receive delivery of alcohol, we require the signature of a person who is over 21 years of age.  It is a violation of the law to lie about your age to purchase alcohol, present false identification, or make arrangements with us to purchase alcohol for you if you are under the age of 21 years.  We retain the right to not deliver alcohol to anyone for any reason.
